At the meeting of the committee The State Duma of the Russian Federation on state construction and legislation recommended that the lower house of Parliament adopt in the first reading government bills on changing the process of destroying counterfeit light industry goods.

The draft federal law being adopted has been developed by the Russian Ministry of Industry and Trade in order to optimize the procedure for the destruction of light industry goods seized in criminal cases. The need for such optimization is caused by the current critical situation, which requires systemic stringent measures to counter the illegal turnover of light industry goods. It proposes to empower the Russian government with the authority to approve the procedure for thenullity of light industry goods seized during criminal proceedings and to develop a simple and understandable method for their identification.

The draft proposes to fix the obligation of the person responsible for committing an offense to reimburse the procedural costs associated with the destruction, disposal of material evidence, in particular with the destruction of light industry goods seized during criminal proceedings. With the proviso that the guilt of the person must be established. The costs incurred for the destruction of light industry goods will be attributed to procedural costs. This will make it possible to destroy them as quickly as possible within the framework of criminal cases, which will help reduce the costs of public authorities for their storage.

According to the second draft law, it is proposed to set out the norm on the destruction of light industry goods seized in cases of administrative offenses in a new edition and establish that the destruction of such goods can be carried out only by a court decision.
