december 18 The State Duma of the Russian Federation at the plenary session adopted The Law on Temporary Legal Protection of Industrial Designs of the domestic fashion industry. The law provides for amendments to the fourth part of the Civil Code of the Russian Federation.
In the explanatory note to the project, it was noted that the currently existing mechanisms of patent and legal protection of design solutions that meet the requirements established for industrial designs are not applicable to the design of clothing, shoes and accessories due to the rather long registration periods of industrial designs. The draft law proposes the protection of industrial designs by introducing a regime of their temporary legal protection by analogy with the existing mechanism for inventions.
The author of the bill, the deputy Natalia Kostenko, previously stated that the project is aimed at supporting and developing light industry through improving the mechanism of patenting industrial designs by providing temporary legal protection to the results of intellectual activity in the field of design. Kostenko also reported that patenting samples will help Russian designers to protect their rights.
"There were designers who told what they do, for example, prints, send several options to the customer, who approves one option and enters into a contract for it, and uses all the other samples. At the same time, the designer has no protection of his intellectual rights. It takes 20 months to get a patent," Kostenko explained earlier.
