Changes in the public procurement procedure

From June 1, 2018, an amendment to the Decree of the Government of the Russian Federation of January 14, 2017 comes into force. №9 «On the establishment of a ban on the admission of goods originating from foreign countries, works (services) performed (rendered) by foreign persons for the purposes of procurement of goods, works (services) for the needs of national defense and state security", introduced Resolution of the Government of the Russian Federation No. 498 of April 24, 2018.

 

 

According to the specified change, in order to confirm the production of industrial products on the territory of the Russian Federation, it will be necessary to submit a conclusion on the confirmation of the production of industrial products on the territory of the Russian Federation, issued by the Ministry of Industry and Trade of Russia in accordance with the Rules for issuing an opinion on the confirmation of the production of industrial products on the territory of the Russian Federation, approved by the Decree of the Government of the Russian Federation of July 17, 2015 No. 719 "On the confirmation of the production of industrial products in the Territory of the Russian Federation".

 

It should be particularly noted that the conclusion will need to be submitted only with respect to industrial products contained in the Annex to Resolution No. 719, if the procurement documentation prohibits the admission of goods originating from foreign countries in accordance with Resolution No. 9. In order to obtain an opinion on the products contained in the Annex to Resolution No. 719, an examination certificate issued by the Chamber of Commerce and Industry of the Russian Federation must be submitted to the Ministry of Industry and Trade of the Russian Federation.

The requirement to submit an opinion applies to legal relations related to the procurement of goods, works, services for state and municipal needs, notices of which are posted in the unified information system in the field of procurement, or invitations to participate in which are sent after June 1, 2018.
